1. General provisions
These Terms of Use (the “Terms”) govern access to the Wistium Platform software (the “Platform”).
The Platform is developed and provided by SQEEL LLC (ООО «СКИИЛ», OGRN 1227700890735, INN 9704188919, KPP 770401001; address: 121099, Russian Federation, Moscow, 2nd Smolensky Lane, 1/4, floor 5, room 6, office 7).
Actual commercial use of the Platform may also be governed by Yandex Cloud Marketplace terms, subscription terms and/or an individual agreement. These Terms do not replace those documents and do not set Marketplace commercial terms.
2. About Wistium Platform
Wistium Platform is a software suite for master data management, data intake, modelling and related platform services. The available modules depend on the installed configuration.
A customer-installed instance of the Platform runs in the customer’s infrastructure. The public demonstration environment on wistium.ru and demo.wistium.ru is operated by SQEEL LLC.
3. Right to use
The user may use the Platform within the access, licence, subscription or agreement granted. Commercial terms, payment and subscription scope are governed by Marketplace, subscription or contract and are outside these basic Terms.
4. Accounts and access
The user must keep account credentials confidential and must not share access with unauthorised persons. The customer determines who may access the customer’s own instance of the Platform.
The operator may restrict or terminate access in case of a breach of these Terms, security requirements or applicable law.
5. User data
The customer and the user are responsible for the legality, accuracy and content of information they upload and process in the Platform.
SQEEL LLC does not claim ownership of customer business data. Customer business data remains customer data and remains under the customer’s control.
6. Acceptable use
The following is prohibited:
- unauthorised access to the Platform or to other persons’ data;
- attempts to bypass authorisation or access controls;
- attacks, vulnerability probing or other interference with Platform operation;
- unlawful use of the Platform;
- disrupting Platform operation, including unjustified overloading of infrastructure.
7. Intellectual property
Wistium software, source code, interface, trademarks and other brand assets remain the intellectual property of their respective rights holders. These Terms do not transfer such rights except for the limited right to use the Platform.
8. Updates and support
The Platform may be updated. Updates may modify, extend or improve functionality. The scope of support is defined by contract, subscription or Marketplace terms and does not imply unlimited support.
9. Liability
The Platform is provided for use as available in the relevant instance. These Terms do not promise 99.99% availability, zero downtime, unlimited support or specific recovery times unless such commitments are expressly established in a contract, subscription or Marketplace terms.
The parties are liable to the extent provided by applicable law and the relevant agreement.
10. Changes to these Terms
SQEEL LLC may update these Terms. The current version is published at https://wistium.ru/terms/terms.en.html. Continued use of the Platform after a new version is published constitutes acceptance of that version, unless otherwise provided by contract.
